End User License Agreement (EULA)

By using and/or accessing the software or other material distributed through the MJHK Studios website, or MJHK Studios material redistributed through another party, the user agrees to abide by this End User License Agreement (EULA).

The current, applicable version of this EULA is that posted for public display on the MJHK Studios website, as managed by MJHK Studios. This shall pertain to all material distributed through the MJHK Studios website, or to any MJHK Studios material distributed by another party. Unless stated otherwise in an agreement accompanying individual material, this agreement shall take precedence over any statement included with the individual material, which shall be considered to be included for conveinience and reference only. All such included statements shall clearly indicate what portion, if any, may be considered to be supplementary or to supercede this version of the EULA.

MJHK Studios hereby grants permission to copy and/or distribute the contents of the shareware version of the DA Instalation Package and/or the DA Upgrade Package, provided that the entire package is freely distributed and that it's contents are not modified in any way.

This specifically excludes the contents of the DA Registration Package or any information gathered through or related to the registration process, including but not limited to Usernames, Passwords, and Registration Codes. Registration information is distributed for personal, individual use only. Redistribution of any material or information attained through the registration process is in violation of this agreement.

MJHK Studios makes no caim to the ownership or copyrights of material distributed through DA that is not written by MJHK Studios or a representative thereof. All rights and ownership are retained by the original author and/or publisher of the material, and it is the responsibility of said author and/or publisher to comply with all applicable copyright laws.

MJHK Studios hereby grants permission to registered users of DA to freely distribute material for use in DA, provided that the user attains legal permission from the copyright holder, complies with any terms established by the copyright holder, and/or owns copyrights to the material to be distributed. In the case that the material is a combination of the above, the user must indicate what portion of the material originated through another party, and give proper credit to the copyright holder, indicating any terms of use attained from the copyright holder. MJHK Studios specifically prohibits distribution of material for a fee for use in DA without a written agreement from MJHK Studios. Distribution of material through the MJHK Studios website as managed by MJHK Studios is considered to be in compliance with this requirement.

By default, users of material distributed for use in DA are granted the following license. (This section may be amended via the inclusion of a License Addendum or Revised License Statement with the individual distributed material. Any changes to this default license agreement must be available to the user prior to importing the material into DA, such as via an included text file, and be clearly identified as a license agreement.):

All materials distributed for use in DA are property of the original author and/or copyright holder. Registered users of "DA: The Role Player's Digital Assistant" are hereby granted license to use, copy, modify, add to, and redistribute the material in accordance with the DA License Agreement. Additionally, the user is required to offer this license with all distributed material derived from any DA material distributed under this liscense, and to credit the original author and/or copyright holder and any other authors who have claimed rights as contributors. Authors may claim copyrights in accordance with this license for any original material distributed under this license, provided that they clearly indicate what is considered original material and what is redistributed material, along with credits for the original author(s) and/or copyright holder(s). It is the responsibility of the distributing user to comply with any applicable copyright laws and/or obtain any required authorization from copyright holders.

Please note that this is a beta-version of DA: The Role Player's Digital Assistant. Not all features may be fully implimented or refined. As with any beta-version software there may be unresolved issues despite our testing. Do not install this beta version of DA unless you are comfortable testing beta software. By installing the beta version of the software, you agree not to hold MJHK Studios liable for any damages or complications arising from the use of the software.

MJHK Studios shall not be held liable for any claims or damages, including but not limited to those resulting from the use or distribution of material distributed through the MJHK Studios website or MJHK Studios material redistributed through a third party. By accessing and/or using the material, the user agrees not to hold MJHK Studios liable for any damages in excess of the list price or actual purchase price paid, whichever is less. Furthermore, MJHK Studios will not be held liable for any claims or damages arising from the distribution of material for which we hold no copyright to or responsibility for.

Other than as provided in an individual license agreement included with individual downloads, to the extent permissible by law MJHK Studios specifically disclaims all warranties, express or implied, with regard to any material made available through the MJHK Studios website or MJHK Studios material redistributed through a third party. Any material distributed without such warranty or license agreement is offered on an "as is" basis. MJHK Studios makes no representation that the material made available through the MJHK Studios website or MJHK Studios material redistributed through a third party is "error free" or necessarily suited to the needs or requirements of individual users.
